Disciplinary Offenses Warranting a Warning
ARTICLE 4 – (1) The following actions warrant a warning:
a) Failing to respond in a timely manner to matters raised by higher education institution officials without a valid reason,
b) Posting notices in locations other than those designated by the higher education institution’s authorities,
c) Tearing down, tearing up, altering, defacing, or soiling notices, schedules, and similar materials posted with the higher education institution’s permission.
Disciplinary offenses warranting a reprimand
ARTICLE 5 – (1) The following actions warrant a reprimand:
a) Providing incomplete or incorrect information requested by the authorities of the higher education institution,
b) Disrupting the order of activities such as classes, seminars, practical sessions, laboratory work, workshops, scientific meetings, and conferences,
c) (Amended: RG-7/11/2013-28814) Distributing leaflets, or hanging posters and banners without permission within the higher education institution,
ç) Tearing down, tearing up, altering, defacing, or soiling announcements, schedules, and similar materials posted by the higher education institution,
d) Attempting to cheat on exams.
Disciplinary offenses warranting suspension from the higher education institution for a period of one week to one month
ARTICLE 6 – (1) The following actions warrant a suspension from the institution of higher education for a period ranging from one week to one month:
a) (Amended: RG-12/23/2016-29927) Engaging in actions that hinder the freedom of learning and teaching or disrupt the operation and peace of higher education institutions,
b) Obstructing the proper conduct of disciplinary investigations,
c) Transferring a document issued by a higher education institution that grants one’s own rights to another person for their use, or using a document belonging to another person,
ç) Engaging in verbal or written actions that undermine the honor and dignity of individuals at a higher education institution,
d) Engaging in verbal or written actions that undermine the honor and dignity of higher education institution staff, whether within or outside the institution,
e) Consuming alcoholic beverages at a higher education institution,
f) Organizing meetings in enclosed or open areas belonging to a higher education institution without permission from the authorities.
Disciplinary offenses warranting suspension from the higher education institution for one semester
ARTICLE 7 – (1) The following actions warrant a one-semester suspension from the higher education institution:
a) Threatening higher education institution staff and students,
b) Engaging in acts that disrupt the services of the higher education institution through occupation or similar actions,
c) Physically assaulting institution staff and students,
ç) Committing theft at higher education institutions,
d) Damaging buildings, fixed assets, or similar materials on the institution’s premises, or causing harm to the institution’s information systems,
e) Cheating on exams or facilitating cheating,
f) Committing plagiarism in seminars, theses, and publications,
g) (Added: RG-12/23/2016-29927) Failing to comply with a decision to suspend from the institution of higher education, despite having received such a penalty.
Disciplinary offenses warranting a two-semester suspension from a higher education institution
ARTICLE 8 – (1) The following actions warrant a two-semester suspension from a higher education institution:
a) Using force or violence against higher education institution staff to prevent them from performing their duties,
b) Using force or violence against students to prevent them from benefiting from higher education services,
c) (Amended: RG-7/11/2013-28814) Committing criminal acts or coercing or threatening an individual or group to organize or participate in a criminal act,
ç) Using, carrying, or possessing narcotic or stimulant substances within higher education institutions,
d) Cheating on exams through threats; preventing students who are cheating from being removed from the exam room; having someone else take an exam in one’s place; or taking an exam in someone else’s place,
e) Committing sexual harassment at higher education institutions,
f) Committing acts contrary to the Law No. 6136 on Firearms, Ammunition, Knives, and Other Weapons, dated July 10,1953, No. 6136, “Law on Firearms, Knives, and Other Instruments,” by carrying or possessing firearms and their ammunition, as well as knives and other instruments specially designed for attack or defense, explosive materials,
g) Gaining unauthorized access to a higher education institution’s information system to obtain an unjustified benefit for oneself or another person.
ğ) (Added: RG-12/23/2016-29927) Threatening those assigned to conduct an investigation.
Disciplinary offenses warranting expulsion from a higher education institution
ARTICLE 9 – (1) The following actions warrant expulsion from a higher education institution:
a) Provided that a court decision has become final, establishing an organization for the purpose of committing a crime, managing such an organization, or being a member of an organization established for this purpose; or, without being a member, engaging in activities on behalf of the organization or aiding it;
b) Selling, purchasing, providing to others, or trafficking in narcotic or psychotropic substances within higher education institutions,
c) Using firearms, ammunition, knives, or other devices specifically designed for attack or defense, as well as explosive materials, in violation of Law No. 6136 on Firearms, Knives, and Other Devices,
ç) Violating a person’s sexual integrity by engaging in sexual acts on their body.
Unforeseen Disciplinary Offenses
ARTICLE 10 – (1) In addition to disciplinary offenses warranting suspension or expulsion from a higher education institution, individuals who commit acts similar in nature and severity to those warranting a warning or reprimand shall also be subject to the same type of disciplinary sanctions.
Recidivism
ARTICLE 11 – (1) In the event of a repeat of an act that has previously resulted in a disciplinary penalty, a penalty one degree more severe shall be imposed.
(2) In cases of recurrence of a disciplinary offense, expulsion from the institution of higher education may not be imposed.
